Terms and Conditions

All orders placed by the “hirer” and accepted by “Izzy Pops Candy Carts & Events” are subjected to these terms and conditions of sale.

All descriptions and illustrations contained in this website are only intended to give a general idea of the service/product offered. Where an offered product is no longer available, we reserve the right to substitute with a product of equivalent value and quality.

Payment

All prices quoted are in £ sterling. Unless otherwise stated, delivery, packaging, installation and collection are included the quoted price.

We accept payment by cheque, cash, PayPal or internet bank transfer.

A 20% non-refundable booking fee is required at time of booking.

Where applicable, a £75 deposit is required to cover loss and/or breakages. This payment is collected when the final balance is paid and is returned within one week of your event, subject to deductions for any loss and/or damage to our equipment.

Final balance is due 6 weeks before event date. In the event that the final balance is not paid by the due date, Izzy Pops Candy Carts & Events reserve the right to cancel your booking. Should this situation occur your deposit is not refunded.

Loss and/or breakage

The hirer will make all reasonable efforts to ensure that our equipment is not misused or damaged during the period of hire. The hirer shall not sell, attempt to sell or hire or sublet any of our equipment. Disposal of our equipment is strictly forbidden.

If you are hiring on behalf of a business or organisation you confirm that you have the necessary authority to enter into this contract on behalf of that business or contract and that you will indemnify Izzy Pops Candy Carts & Events against any loss or expense due.

The hirer shall reimburse Izzy Pops Candy Carts for any equipment stolen, missing or damaged beyond economical repair.

If equipment is lost or stolen the hirer shall reimburse Izzy Pops Candy Carts & Events for the full retail value of replacement of the items(s). Where equipment is damaged beyond economical repair, the hirer shall reimburse Izzy Pops Candy Carts & Events for the full retail value of replacement of the items(s).

Where equipment is returned to us damaged, we shall charge the hirer for the full costs of repair/reinstatement of the damaged item. Any deposit due to the hirer after deduction of loss/damage costs may, at the discretion of Izzy Pops Candy Carts & Events be delayed until the repaired/replacement items are made available for future hire.

Delivery

Unless otherwise stated, all equipment hired from Izzy Pops Candy Carts & Events is delivered, erected, dismantled and collected by our staff. Under no circumstances should our equipment be dismantled or moved after installation by any unauthorised persons.

Our estimated time for delivery will be stated on our quote. You should allow us up to one hour for setting up of your Candy Cart and/or equipment package. Additionally we require up to one hour for dismantling and removal of equipment upon completion of the contract.

If we are not permitted access to the event for installation or removal of our equipment by the agreed time, Izzy Pops Candy Carts & Events reserves the right to charge a late fee of £20 per hour, or part thereof.

Where it has been agreed that collection of our equipment will be undertaken the following day, the hirer shall be responsible for organising access to the premises for our staff at a suitable time and date. Normally, this would be the morning after the event.

We aim to deliver on time as agreed in our quote but occasionally delays beyond our control may occur, despite our best efforts. Izzy Pops Candy Carts & Events shall not be held liable for any delay or failure to deliver within agreed timescales.

In the unlikely event that Izzy Pops Candy Carts & Events are unable to service or complete your event we shall return the hirers payments made to date. Izzy Pops Candy Carts & Events shall not be responsible for any cost incurred by the hirer as a result of our failure to complete the contract.

Privacy Policy and Data Protection

We guarantee that any of your details held by us will not be disclosed to third parties. We hold your details under the Data Protection Act 1998. Your details are used by us for delivery of your service/package. You can request removal of your details from our database at any time.

Nut Allergies

We source our candy from different manufacturers and we are aware of the potential health risks to people who are allergic to whole peanut, nuts or nut derivatives. Izzy Pops Candy Carts & Events cannot guarantee that products supplied by us will not have traces of nuts or nuts derivatives.

We do hold an ingredients list of all our candy products, this is available upon request.

As manufactures of candy may involve the same production line for candy with or without nuts or nuts derivatives, we cannot guarantee 100% that your candy will not contain traces of nuts. There is always the risk of cross contamination in the food chain, please bear this in mind if you are at risk from any food allergy.

All our candy products are handled by our staff using hygienic food standard gloves. All staff are qualified to industry standard food handling requirements.

Should you require specific information about a certain product then please contact us and we will do our best to answer any queries you may have.

Acceptance of Terms and conditions

By paying the required deposit to Izzy Pops Candy Carts & Events you the hirer are deemed to have accepted and agreed to our terms and conditions of contract. English law applies to the contract between us.

Cancellation Fees:

Less than 6 weeks prior to event – 50% of total quoted price

Less than 4 weeks prior to event – 75% of total quoted price

Less than 2 weeks prior to event – 90% of total quoted price

Less than 1 week prior to event – 100% of total quoted price

Any hirer who wishes to cancel must do so by email to: izzypopscandycart@aol.com

Complaints

In the unlikely event of your dissatisfaction of the services supplied you must inform Izzy Pops Candy Carts & Events by email within 72 hours of completion of your event. We reserve the right to dismiss any complaint submitted outside the 72 hour period. Any complaint should be emailed to:  izzypopscandycart@aol.com

Limitation/Disclaimer Liability

Izzy Pops Candy Carts & Events cannot accept responsibility for any loss or damage to our equipment and produce/candy once set up at a venue.

Please note that candy/food items are non-returnable.

Izzy Pops Candy Carts total liability for any claim or claims howsoever arising shall not exceed the value of the goods/services supplied. We shall not be liable for any consequential cost or losses associated with any claim irrespective of blame.

Please note that any pictures used for advertising our products and services are for illustration only and the product or service may vary from that shown. We will endeavour to replace any unavailable product with a similar alternative.

The hirer agrees to indemnify us at all times in respect of all claims by any person or organisation in relation to any injury, loss or claim or expense arising out of or in connection with the use of the services or equipment provided.

Under no circumstances shall Izzy Pops Candy Carts & Events be liable to the hirer or other persons or organisation for any damages resulting from or related to any failure or delay to provide services under this contract if such failure or delay is due to strikes, weather, fires, riots, acts of god, theft, terrorism or vandalism or other causes beyond our control as defined in law. Such a failure or delay shall not constitute a default under this agreement.

The contract between Izzy Pops Candy Carts & Events and our customer (the hirer) shall be governed by and interpreted in accordance with English Law and the English courts have jurisdiction to resolve any dispute between us.

Izzy Pops Candy Carts & Events hold public and employee liability insurance and staff are CRB checked.
